Legal
Terms of Service
These terms govern your use of Lunia structural analysis and design software. Please read them before you buy or install.
1. Who you are contracting with
Lunia is published by Deskfine Software Limited, a private limited company incorporated in Kenya under the Companies Act, 2015, company number PVT-ZE1AM37V, with its registered office at Rikana House, Jogoo Road, Makongeni, Nairobi, and its postal address at P.O. Box 72723 – 00100 G.P.O., Nairobi, Kenya ("we", "us", "our"). You can reach us at info@luniatech.com.
Where you buy through a reseller or payment platform acting as merchant of record, your purchase contract is with them and their terms govern payment, tax and refunds. These terms still govern your use of the software.
2. What you are buying
You are buying a licence to use Lunia. You are not buying the software itself. We keep all intellectual property in the program, its engineering data and its documentation.
Every licence includes the complete program — modelling, analysis, concrete and steel design, foundations, detailing and drawings — and every design code we support. We do not sell cut-down editions.
3. Licences are per computer
A licence permits installation and use on a stated number of computers. One seat means one computer. A second computer needs a second seat, and a seat is held by the machine it is activated on until it is released.
You may release a computer yourself at any time from your account, which frees its seat for another machine. Releasing a computer you no longer control does not by itself remove the software from it.
You may not:
- share your account credentials with anyone outside your organisation;
- use one licence on more computers than it covers;
- copy, resell, rent, sublicense or redistribute the software;
- reverse engineer, decompile or disassemble it, or attempt to extract or defeat its licensing or its encrypted engineering data, except to the extent that this restriction cannot lawfully be excluded;
- remove or obscure any notice of ownership.
4. Signing in, and working offline
Lunia is activated by signing in with your email address and password. The software then works without an internet connection for up to 20 days between check-ins with our licence server.
After 20 days offline it will ask you to connect before continuing. This is not a fault and does not mean your licence has lapsed. If you expect to work somewhere with no connection for longer than this, tell us before you travel and we will arrange it.
We aim to keep the licence server available at all times, but we do not guarantee uninterrupted availability. The offline window exists so that a server outage does not stop you working.
5. Trial licences
A trial gives you the complete product for 15 days, with no feature limits and no watermark on drawings. Trials are limited to one per computer. At the end of the trial the software stops designing until a licence is bought; files you created remain yours and remain readable.
6. Subscription licences
Monthly and annual subscriptions run until cancelled. If a subscription lapses, the software continues to work for a short grace period and then stops. Cancelling stops future charges; it does not refund the period you have already paid for.
7. Perpetual licences
A perpetual licence is bought once and does not expire. Maintenance covers upgrades and support for a stated period, and may be renewed or allowed to lapse. When maintenance lapses the software keeps working — you continue to use the version you own indefinitely. You simply stop receiving new versions until maintenance is renewed.
8. Your projects stay yours
Models, drawings, reports and any other output you produce with Lunia belong to you. We claim no rights over them and charge no royalty on them.
Opening a project file you have already created will continue to work regardless of the state of your licence — including after a subscription ends. We will not lock you out of your own work.
9. ⚠ Engineering responsibility
Lunia is a tool used by a qualified engineer. It does not replace one. You remain professionally and legally responsible for your designs, including for checking the inputs you give the software and the results it produces.
We take the correctness of our implementations seriously and verify them against published codes, worked examples and independent sources. Even so, no structural software is free of error, and results must be checked by a competent engineer against first principles and the governing design code before being relied on or issued for construction.
10. Warranty and liability
The software is provided "as is". To the fullest extent permitted by law we exclude all implied warranties, including fitness for a particular purpose.
To the fullest extent permitted by law, our total liability arising out of or in connection with the software is limited to the amount you paid for the licence in the 12 months before the claim. We are not liable for indirect or consequential loss, loss of profit, loss of data, or the cost of remedial work to a structure.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected.
11. Suspension and termination
We may suspend or terminate a licence if it is shared beyond its seat count, if payment is reversed or charged back, or if these terms are seriously breached. Where it is reasonable to do so, we will contact you first and give you a chance to put it right.
You may stop using Lunia at any time. See our refund and cancellation policy.
12. Changes to these terms
We may update these terms. For material changes affecting an active licence we will give reasonable notice by email. Continuing to use the software after a change takes effect means you accept the updated terms.
13. Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction — except that, if you are a consumer, you may also bring proceedings in the country where you live.
